Did you know that the condominium and homeowner’s associations in Florida have the power to approve or deny potential renters and buyers of homes in their community? Although these associations must comply with the Fair Housing Act (FHA), it may be within their legal right to deny approval to a potential applicant with a blemished past. Not only that, but these HOAs also have the right to restrict visitors and guests, as well. 

Gaining Condominium or Homeowner’s Association Approval

If you’re trying to close on a home that is governed by a condominium or homeowner’s association, consider these tips for a smoother home closing experience:  

  1. Find out the timeline: Many HOAs and COAs have a timeframe in which a potential homebuyer needs to apply. For instance, a buyer must submit their application no later than 30 days before the closing date. 

  2. Follow the instructions: Failure to follow the application instructions may result in the delay or decline of any application. 

  3. Apply early: Submit your application before the deadline to avoid any potential delays. 

Can an Association Deny an Application?

Although the FHA prevents the association from discriminating against race, religion, or age, they do have the right to deny based on criminal background and other past blemishes. Consider these determining factors when filling out the application: 

  1. Criminal background checks;

  2. Financial irresponsibility;

  3. Reasonable cause to believe that the applicant won’t abide by the rules;

  4. Applicant refuses to a meeting with the association; or

  5. The applicant fails to fill out the application.
